These Terms & Conditions govern your access to and use of the Mownii e-commerce platform, including all purchases, services, and interactions conducted through our website and associated services. By visiting, registering, or purchasing from Mownii, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Definitions

Platform: The Mownii e-commerce website and all associated digital services.
User/Customer: Any individual or legal entity accessing or making a purchase on the Platform.
Vendor/Seller: Third-party merchants approved to sell products via Mownii.
Order: A purchase request submitted by the Customer via the Platform.
Contract: The legally binding agreement created once an Order is accepted.

2. Scope and Acceptance

By accessing or using the Platform, you agree to comply with these Terms. If you do not agree, you should refrain from using the Platform. These Terms work alongside our Privacy Policy, Cookie Policy, Return Policy, and Vendor Agreement.

Users must be at least 18 years old to purchase or register an account.

3. Account Registration and Responsibilities

Users must provide accurate, complete, and up-to-date information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
Mownii reserves the right to suspend or terminate accounts for misuse, fraud, or breach of these Terms.

4. Products and Listings

Product images, descriptions, and specifications are provided either by Mownii or Vendors.
Although we strive for accuracy, minor variations may occur due to manufacturing, colour display differences, or vendor updates.
Availability, pricing, and promotions may change without prior notice.
Mownii reserves the right to modify or discontinue products at any time.

5. Ordering and Contract Formation

When you place an order, you are making an offer to purchase a product.
A contract is formed once you receive an Order Confirmation email from Mownii.
If a product becomes unavailable or an error occurs in pricing, Mownii may cancel the order and provide a full refund.
We reserve the right to refuse or cancel orders suspected of fraud, unlawful activity, or breach of these Terms.

6. Pricing and Payment

Prices are shown by default in EUR (€); however, for convenience, Mownii automatically displays product prices in the customer’s local currency based on geolocation or user preference. Final billing will reflect the converted currency at the applicable exchange rate at the time of purchase.
All displayed prices include applicable taxes (VAT or equivalent), in accordance with EU, Luxembourg, and relevant international regulations.
Payments must be made using the approved methods offered on the Platform (e.g., credit card, PayPal, bank transfer, digital wallets, etc.).
Mownii operates through secure, encrypted payment gateways compliant with PCI-DSS global security standards to ensure safe and reliable transactions.
Orders will only be processed once payment has been successfully authorised. If payment fails or is declined, the order will not be confirmed.

7. Shipping and Delivery

Estimated delivery timelines will be displayed during checkout; however, delays may occur due to logistics or external factors.
Ownership of goods transfers to the Customer upon delivery.
Customers are responsible for providing accurate delivery information.

If a package is returned due to incorrect or incomplete information, additional delivery fees may apply.

8. Returns, Refunds & Cancellations

In accordance with EU consumer protection rules (Directive 2011/83/EU on consumer rights):

Consumers have a 14-day withdrawal period from the date of delivery to cancel an order without providing a reason, except for:
Perishable goods
Customized or personalized items
Unsealed hygiene products
Returned items must be unused, in original condition, and with intact packaging.
Refunds will be issued to the original payment method within a reasonable timeframe after inspection.
Shipping costs for returns are the responsibility of the customer unless the item is defective or incorrectly supplied.

9. Vendor Policy

Vendors on the Platform must comply with Mownii’s Vendor Agreement, including obligations relating to:

Product authenticity
Quality standards
Customer service response times
Delivery and return management
Compliance with EU consumer law and safety standards

Mownii reserves the right to remove any vendor violating these rules.

10. User Conduct

Users must not:

Engage in fraudulent or misleading behaviour
Interfere with the Platform’s functionality
Upload harmful or malicious content
Breach intellectual property rights of Mownii or vendors

Violations may result in account termination and legal action.

11. Intellectual Property

All content on the Platform, including logos, graphics, designs, product listings, and software, is owned by or licensed to Mownii.

Users may not reproduce, distribute, or modify any content without written permission.

12. Data Protection & Privacy

Mownii processes personal data in compliance with GDPR (Regulation (EU) 2016/679).

Our Privacy Policy explains how data is collected, processed, and stored.

Users must read and agree to the policy to use the Platform.

13. Limitation of Liability

To the maximum extent permitted by law:

Mownii is not liable for indirect, incidental, or consequential damages arising from the use of the Platform.
We do not guarantee uninterrupted access, error-free operation, or absolute security.
Vendors are solely responsible for products they sell, including quality and legal compliance.

This clause does not limit liability for fraud, gross negligence, or other obligations prohibited from exclusion under Luxembourg law.

14. Indemnification

You agree to indemnify and hold harmless Mownii, its directors, employees, and partners from any claims, losses, damages, or expenses arising from your misuse of the Platform or violation of these Terms.

15. Force Majeure

Mownii is not responsible for delays or failure to perform obligations due to events beyond reasonable control, including natural disasters, strikes, war, or government restrictions.

16. Amendments

Mownii may update these Terms at any time.

Changes will be effective upon posting on the Platform. Continued use signifies acceptance.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Grand Duchy of Luxembourg, in line with applicable EU consumer protection regulations.

Any dispute shall be subject to the exclusive jurisdiction of the Courts of Luxembourg City.
